General Terms and Conditions (GTC)
§ 1 Validity of the General Terms and Conditions
(1) Terminal Apartments, represented by Nadja Remann, operates the website with the URL https://terminal-apartments.de. Terminal Apartments offers apartments for rent on this presentation platform. The following General Terms and Conditions (GTC) apply to all services offered by Terminal Apartments. Terminal Apartments does not accept any other GTC.
(2) The guest's terms and conditions shall only apply if they have been agreed upon in advance. Deviations from these terms and conditions are only valid if the owner listed in the imprint has expressly confirmed them in writing.
§ 2 Booking/Booking Confirmation
Booking requests can be made in the following ways
- by booking directly on this website
- in writing to info@terminal-apartments.de
- by phone (number in the imprint)
- via WhatsApp (number in the imprint)
There is no guarantee that booking requests other than those recorded in writing can be accommodated.
§ 3 Conclusion of contract
(1) A guest's booking request is directed to Terminal Apartments. Any further communication takes place exclusively between Terminal Apartments and the guest, or between the guest and the host. The guest books their accommodation directly on the website www.terminal-apartments.de. By booking, the guest accepts the prices and all other conditions, such as the General Terms and Conditions. Payment and booking constitute the conclusion of the accommodation contract between the guest and the host.
(2) Depending on the guest's choice, payment of the final price is made in advance using various online payment tools. In all cases, the booking must be paid BEFORE departure. Cash payment on site is only possible in extremely rare cases and can only be guaranteed upon explicit request.
(3) Default of payment: Unless otherwise agreed in writing, non-payment of the full amount is considered default starting from the first day of booking. The first reminder in the amount of €10.00 booking amount will be sent 7 days after the start of the trip/first day of booking. The second reminder in the amount of €10.00 ( €10.00 first reminder booking amount) will be sent 14 days after the start of the trip. The third reminder in the amount of €10.00 ( €10.00 first reminder €10.00 second reminder booking amount) will be sent 21 days after the start of the trip. From the 28th day of non-payment after the start of the trip, the claim will be handed over to a debt collection agency. All costs incurred in the collection process, plus reminder fees, are to be borne by the customer/guest.
(4) The apartment may only be entered by the persons listed in the booking. If the apartment is used by more people than agreed upon, a fee of €25 per person per night must be paid and reported BEFORE departure. Violations of this rule will result in a charge of €100 (net) per day for each unregistered person.
(5) Changes to a booking or subsequent booking may be possible provided they are made BEFORE the day of arrival.
(6) Subletting or further letting of the accommodation provided as well as its use for purposes other than residential purposes is prohibited.
§ 4 Arrival and departure
(1) The apartment is available from 4:00 PM on the day of arrival. Key handover will be contactless (a detailed description of how to access the apartment is included in the booking confirmation). Claims for damages cannot be made if, as an exception, the apartment cannot be occupied promptly by 4:00 PM. On the day of departure, the apartment must be vacated by 10:00 AM. The landlord reserves the right to charge for late, unannounced departures.
(2) An early check-in or late check-out is possible upon request, subject to availability, with an additional charge of 10€ each.
§ 5 Condition of the apartment
(1) Terminal Apartments will hand over the apartment in a tidy and clean condition with a complete inventory. Any defects must be reported to the host immediately after check-in. The host must also be notified immediately of any damage that occurs during the rental period. The guest is liable for any damage caused to the rental property and its inventory, e.g., damage to the floor or furniture. The inventory must be treated with care and attention and is intended only for the apartment. The tenant is also liable for the negligence of his or her fellow travelers.
(2) Moving furnishings, especially beds, is prohibited.
§ 6 Additional persons
If more people than booked stay, a fee of €25 per person per night will be charged. Unregistered guests will be charged €150 per person per night.
§ 7 Dogs
The availability of dogs varies by apartment and can be found in the apartment description or inquired about if necessary. Dogs are only permitted with the prior written consent of Terminal Apartments, on behalf of Nadja Remann. The provider charges an additional fee for dogs, which can be found in the house rules. Discounts for longer stays must be agreed upon in advance and documented in writing. Pets brought without the prior consent of the host will be charged a cleaning and violation fee of €75 per pet per night (net). Dogs must be house-trained, may not be left unattended in the apartment, and are not allowed on the bed or sofa. A dog basket is provided. A security deposit of €150 is required prior to arrival. This will be refunded upon return of the apartment in good condition – without urine stains, excessive pet hair on the sofa, and no droppings in the garden.
§ 8 Stay
The apartment may only be used during the booked period.
§ 9 Cancellations
(1) Cancellation by the guest must be made in writing. If this is not done, the agreed price must be paid even if the guest does not use the contractual service.
(2) In case of cancellation of a booking, the following cancellation costs will be charged based on the respective final price of the booking:
Full refund for cancellations if the check-in date is at least 15 days in the future.
50% refund for cancellations made at least seven days before departure.
No refunds for cancellations made within seven days of departure.
(3) Special Conditions: If a guest wishes to have a secure, free cancellation option up until the day of arrival, this can be arranged by paying a special fee. Terminal Apartments must be notified of this immediately after booking! Otherwise, no cancellation policy other than that listed above is possible.
(4) Cancellations by the host (Terminal Apartments) are only permitted for valid reasons.
(4.1) Terminal Apartments, as the landlord, may exercise its right to refuse or cancel a booking. The guest has no right of withdrawal.
(4.2) In the event of cancellation by the host due to force majeure (e.g., burst pipes) or other unforeseeable circumstances, as well as other circumstances beyond its control that make fulfillment of the contract impossible, Terminal Apartments must refund the full booking price or, in the case of an ongoing trip, a pro rata refund. There is no right to compensation.
§ 10 Liability of the landlord
Terminal Apartments's liability towards the guest is excluded to the extent permitted by law. In particular, Terminal Apartments is not liable for damages caused by the guest to the host or vice versa. Data communication via the internet cannot be guaranteed to be error-free and/or available at all times given the current state of technology. The host therefore does not guarantee the constant and uninterrupted accessibility of its internet portal and is not liable for outages due to technical or electronic errors over which the host has no control.
§ 11 Events and parties
Parties or events are not permitted. Violations will result in a fine of up to €750.
§ 12 Smoking
Smoking is not permitted in the accommodation or in the hallway. In case of violation, the accommodation reserves the right to charge a final cleaning fee of €150.
§ 13 Noise
The statutory quiet hours apply between 10 p.m. and 6 a.m. During this time, please keep the noise level at a reasonable level.
§ 14 Severability Clause
Should one or more provisions of these Terms and Conditions become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid one that most closely approximates the economic purpose pursued by the invalid provision.
§ 15 Acceptance of the General Terms and Conditions
The tenant agrees to the general terms and conditions and the house rules of the landlord, Terminal Apartments, represented by Nadja Remann. No written consent is required; the terms and conditions are accepted upon successful booking. In the event of violations of the terms and conditions or the house rules, the landlord is entitled to terminate the tenancy immediately and without notice. There is no legal right to reimbursement of the rent or compensation.
